These Affiliate Program Terms and Conditions ("Agreement") govern the relationship between Transform Today ("Company", "we", "our") and the affiliate ("Affiliate", "you"). By participating in the Affiliate Program, you agree to comply with these terms.
2. Affiliate Responsibilities
• Promotion: You are responsible for promoting Transform Today’s products and services through your affiliate links.

3. Eligible Products and Services
The Affiliate Program covers the following categories:
1. Digital marketing, group, and individual consulting
2. Women's programs, retreats, and mentoring
3. Feminine Power Cards decks
4. Hypnosis, hypnotherapy, and hypno-coaching sessions
4. Commissions and Payments
• Commission Structure: Affiliates will receive commissions based on the sales they generate. Commission rates may vary by product or service category.
• Commission Eligibility: The commission eligibility for repeat purchases varies by product.
• Payment Timing: Commissions will be paid 60 days after the purchase.
• Minimum Payout: Affiliates will receive payouts once their total commissions exceed $50.

5. Use of Brand, Logo, and Marketing Materials
• Permitted Use: Affiliates may use the brand, logo, and marketing materials provided by Transform Today strictly for the promotion of our products and services.

6. Prohibited Practices
Affiliates are prohibited from engaging in the following:
• Spamming or unsolicited email marketing.
• False or misleading claims about products or services.
• Bidding on Transform Today’s branded keywords or using paid search ads.
• Use of deceptive techniques like countdown timers for non-urgent offers.
• Engaging in cookie stuffing, misleading redirects, or using inappropriate content.
• Promoting Transform Today’s products on platforms that violate their terms of service.
7. Termination
• By Transform Today: Transform Today may terminate the agreement at any time with or without cause. Termination for cause may occur if the affiliate violates the terms and conditions.
• By Affiliate: Affiliates may terminate the agreement by providing written notice, typically within 14 days.
• Unpaid Commissions: Affiliates will be entitled to any unpaid commissions earned prior to termination, subject to the usual payout terms. If terminated due to a breach, unpaid commissions may be forfeited or withheld until the dispute is resolved.
8. Confidentiality and Non-Disclosure
• Confidentiality: Affiliates agree to keep any proprietary or confidential information related to Transform Today’s business, products, and services confidential and not share it with third parties without written consent. This obligation lasts for 2 years after termination.
• Non-Disclosure Agreement: Affiliates may be required to sign a non-disclosure agreement (NDA) upon joining the program.
9. Dispute Resolution
• Mediation: If a dispute arises, both parties agree to first attempt resolution through mediation in San Diego, California, with a neutral third-party mediator chosen by mutual agreement.
• Arbitration: If mediation fails, the dispute will proceed to binding arbitration, governed by the American Arbitration Association or other agreed-upon body, and held in San Diego, California. Arbitration costs will be split equally unless otherwise determined.
• Choice of Law: This Agreement will be governed by the laws of the State of California, with venue in the City of San Diego.
10. Severability
If any provision of this Agreement is deemed invalid or unenforceable, the remaining provisions will continue in effect. The invalid provision will be modified to make it enforceable while reflecting the original intent of the Agreement.

Transform Today shall have the right to participate in the defense at its own expense.
o The Affiliate’s obligations under this clause will
survive the termination of this Agreement.
